General information regarding the content of a letter

ARKANSAS RPC 7.1
  • No false or misleading communications
  • No unjustified expectations
  • No comparisons unless factually substantiated
  • No testimonials or endorsements
ARKANSAS RPC 7.3(b)
  • Mailings must be sent by regular mail
  • Mailings must not resemble a legal pleading

Specific information regarding content of a letter

ARKANSAS RPC 7.2
  • Copy of advertising must be kept for 5 years after it was last disseminated along with list of when and where it was used
  • Must contain the name of at least one lawyer licensed in Arkansas and responsible for its content
  • Must disclose geographic area in which the attorneys advertising principally practice law
  • May include pictures or images of the actual attorneys
  • Any actors used must be identified by name and relationship to the advertising attorney
  • Clients, former clients, and dramatization are not to be used.
ARKANSAS RPC 7.3(b)
  • Plainly state "ADVERTISEMENT" on each page of the communication
  • Begin with the statement "if you have already retained a lawyer, please disregard this letter"
  • Include the statement "ANY COMPLAINTS ABOUT THIS LETTER OR THE REPRESENTATION OF ANY LAWYER MAY BE DIRECTED TO THE SUPREME COURT COMMITTEE ON PROFESSIONAL CONDUCT c/o CLERK, ARKANSAS SUPREME COURT 625 MARSHALL STREET, LITTLE ROCK, ARKANSAS 72201
  • Must disclose how lawyer obtained info prompting communication

Arkansas Advisory Opinions

  • ADVISORY OPINION 2004-02: Academic degrees of any kind can be used on business cards or other advertising
  • ADVISORY OPINION 2003-03 The Arkansas RPCs do not govern advertising financing. Arkansas firm can enter into agreement with out-of-state firm in which the out-of state firm pays for advertising by in state firm. After initial consulation, with in-state firm client is referred to out-of state firm. This is not mentioned in the advertising
